BOX OFFICE TERMS AND CONDITIONS: OPEN AIR PERFORMANCES


  1. These are the terms and conditions on which we supply services to you. For details on how we collect and use information you provide to us, see our Privacy Policy.

  2. Please read these terms carefully before you submit your order to us. If you think there is a mistake in these terms, please contact us to discuss.

  3. Please note that our auditorium and stage are completely uncovered and performances may be cancelled or abandoned because of the weather. Tickets are non-refundable in the event of cancellation because of the weather but may be exchanged in accordance with our policy set out below

  4. ATTENDING OUR PERFORMANCES SAFELY DURING CORONAVIRUS (COVID-19)

    1. Coronavirus (COVID-19) is an infectious disease that can result in serious and potentially fatal illness. The risk of transmission is increased where people gather together. Some people are at a higher risk than others. Although we are implementing heightened safety measures, the risk cannot be entirely eliminated and, by attending the venue, you assume all risk associated with COVID-19 (unless caused by our negligence).

    2. Tickets are only available in fixed groups, where 1, 2, 3 or 4 tickets are seated together and each group is distanced in line with government guidance from the other groups in the auditorium. All tickets within a particular group must be purchased by one booker. Each group must only consist of one household or support bubble. Performers are also distanced from audience members in line with government guidance.

    3. We will collect contact data about each ticket booker in line with our Privacy Policy. We may need to share your contact details with NHS Test and Trace, if they require.

    4. At the venue you must:

      1. abide by all relevant government guidance;

      2. abide by: all instructions given by our staff; our signage; and our full terms and conditions;

      3. wear a face covering where required; and

      4. maintain a distance of 2 metres where possible (and otherwise no less than 1 metre) from all other households or support bubbles at the venue at all times.

    5. You must not attend the venue if you:

      1. believe you may be infected with COVID-19;

      2. have experienced symptoms in the last 14 days;

      3. have been in close proximity to anyone who has experienced symptoms in the last 14 days;

      4. have arrived in England in the last 14 days and are not covered by the exemption rules relating to self-isolation; or

      5. have been instructed to self-isolate.

      6. Any individual who considers themselves to be clinically extremely vulnerable or who is in the same household or support bubble as someone who considers themselves to be clinically extremely vulnerable is advised not to attend.

    6. If we are required by any COVID-19 government guidance or restrictions to cancel a performance, tickets may be exchanged or refunded as set out below.

  5. INFORMATION ABOUT US AND HOW TO CONTACT US

    1. We are Red Kite Theatre, a registered charity. Our charity registration number is 800418.

    2. You can contact us by writing to us at chairman@redkitetheatre.com or by writing to Red Kite Theatre, 2 Andrew's Reach, Bourne End, Bucks SL8 5GA.

    3. If we have to contact you we will do so by telephone or by writing to you at the e-mail address or postal address you provided to us in your order.

    4. When we use the words "writing" or "written" in these terms, this includes e-mails.

  6. OUR CONTRACT WITH YOU

    1. You can order tickets online.

    2. Our acceptance of your order will take place when we write to you to accept it, at which point a contract will come into existence between you and us.

    3. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the transaction. This might be because the show you have tried to buy a ticket for is sold out, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the show or because we are unable to meet a delivery deadline you have specified.

    4. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

  7. TICKETS

    1. The price of the ticket shall be the price set at the time we accept your booking, inclusive of any applicable taxes but exclusive of any booking, collection or delivery fee.

    2. The ticket holder has a right only to a seat of a value corresponding to that stated on the ticket. Please note that seating plans provided at the time of booking are only representative of the auditorium layout and may alter to incorporate individual production staging requirements. Accordingly, we reserve the right to relocate your seats and provide alternative seats of no less value to those specified on your ticket. We will notify you if your original seat is affected by any alterations in seating arrangements.

    3. At our discretion, changes may be made to the advertised programme owing to circumstances beyond our reasonable control. This includes the use of understudies.

    4. Please check your tickets carefully on receipt and contact us immediately if there is a mistake.

    5. Resale for profit: We reserve the right to refuse to sell tickets to anyone we have reasonable grounds to believe is purchasing for the purposes of resale. Unless given express permission by us, tickets may not be resold or transferred for profit or commercial gain. Any ticket in breach of these terms and conditions shall be void and its holder will be refused entry. If you can no longer attend a show, we can arrange for a resale of your ticket.

    6. Delivery:   Tickets will only be delivered to the billing address of the credit/debit card holder unless we specifically offer you the facility for tickets to be sent to an alternative address. There is a postage charge of £2 per booking. We cannot post tickets to you to an address outside the UK or if you completed your booking 14 days or less from the date of the show; in these circumstances, you may collect your tickets in person at the box office or use an e-ticket. Where tickets are collected in person at the box office, the cardholder must present the credit or debit card used to make the booking. In the case of e-tickets patrons must ensure they bring their printed e-ticket and ID.

  8. REFUNDS, EXCHANGES AND RETURNS

    1. Tickets may only be exchanged or refunded in the case of a cancelled show. However, refunds are not given for cancellation or abandonment of a show as a result of the weather (see section 6.7 about exchanging tickets for weather-related cancellations).

    2. These performances are open air theatre, and both the auditorium and stage are completely uncovered. Patrons therefore accept that weather, climate, temperature and light conditions, which are out of our control, are an integral part of the experience and may impact on their visit.

    3. While we will make every effort to complete each show, we reserve the right to stop and start the show as necessary.

    4. Shows will only ever be cancelled or abandoned in the event of bad weather, where such weather is deemed by the management to pose a health and safety risk for the performers. 

    5. In some cases, we may choose to delay the start time of a show for reasons including because of weather forecasts we may have received. We will not delay the start time of a show for more than 1 hour.

    6. If a show is cancelled on account of the weather, we will announce this at the time of cancellation at the venue. We do not communicate cancellations to patrons who did not come to the venue or who have already left the venue. However, you will still be able to benefit from our policy for exchanging tickets following a weather-related cancellation.

    7. Exchanging tickets for weather-related cancellation:

      1. If a show is cancelled or abandoned because of the weather, you will be entitled to exchange your ticket for seats available with the nearest value to your original ticket (rounded-up) at any other Red Kite Theatre show, subject to availability. There is no time limit on exchanging tickets in this way.

      2. Subject to availability: Your ability to exchange into a particular show on a particular date and time will be subject to the availability of seats at that show on that date and time. This will be assessed at the point when we are processing your request for an exchange.

    8. Other cancellations and resales:

      1. For non-weather related cancellations, only the face value of your ticket is refundable. This excludes any booking fees, delivery charges or other expenses incurred. In any event, personal arrangements including travel, accommodation or hospitality relating to the event which have been arranged by you are at your own risk and not refundable by us.

    9. Void tickets are non-exchangeable and non-refundable.

    10. We can accept tickets for resale but we will only attempt to resell them once a show is sold out and cannot guarantee that they will be resold. An administration charge of £1 per ticket will be made for each ticket successfully resold.
